General Terms and Conditions for Users (Clients) on Mcket

Effective Date: June 12, 2025

These General Terms are applicable to all interactions between the User and SOMAME APP LTD concerning the utilization of the Mcket platform and specific elements of Sales Agreements and Delivery Agreements established via the Mcket Platform. Upon registration for the Mcket platform, the User acknowledges and consents to the enforcement and substance of these General Terms.

1. DEFINITIONS

1.1 SomaMe

SomaMe refers to SOMAME APP LTD, a company registered with registration number: C0063947935 and its primary address at Kumasi, Ghana, and can be contacted via email at mckettechnologies@gmail.com.

1.2 User

User refers to any natural person, sole entrepreneur, or legal entity registered on the Mcket platform to use the Errand service.

1.3 Errand Agreement

Errand Agreement is the agreement between the Vendor, Customer and the Errander for the selling, buying and delivery of Goods or services ordered through the Mcket platform.

1.4 Pick-Up Location

Pick-Up Location is the address specified in the order where the purchasing is done. This is the address provided by a Vendor, unless it is a custom vendor which the user would provide.

1.5 General Terms

General Terms refer to these terms and conditions that govern the relationship between SomaMe and the User in relation to the use of the Mcket platform.

1.6 Vendor

Vendor refers to any natural person, sole entrepreneur, or legal entity registered on the Mcket Vendor platform to participate in the Errand service.

  • Verified Partner: Vendor approved by SomaMe after verification process
  • Custom Vendor: Unverified vendor selected by customers at their own risk

2. LEGAL FRAMEWORK

2.1 Mcket platform

The Mcket platform (Mcket, Mcket Errander and Mcket Vendor) facilitates the connection between Users seeking buy-for-me service or errand services. Erranders and Vendors mediate such services. SomaMe acts as a provider of the information society service and is not a party to the Errand Agreement.

2.2 Errand Agreement

For the delivery of Goods or services through the Mcket platform, an Errand Agreement is concluded directly between the User, Vendor and the Errander. SomaMe is not a party to the Errand Agreement and is not liable for its performance.

2.3 Agency Relationship

SomaMe acts as an agent for Erranders in mediating Errand Agreements between Erranders and Users. SomaMe is authorized by each Errander to receive payments from Users on behalf of the Errander and allocate the received funds to Erranders. SomaMe also publishes verified and trusted Vendors for Users to buy from.

3. ORDERING THROUGH MCKET PLATFORM

3.1 Placing Errands

Users can place Errands through the Mcket platform. Erranders may contact the User to agree on changes to the Errand if needed.

3.2 User's Rights

Users have the right to receive services that comply with their description on the Mcket platform. Any specific requirements agreed upon must be met.

3.3 Errander's Fee

Erranders are entitled to receive Errand Fees for the services provided. The calculation principles are outlined in Section 6.

3.4 Errand Amount

Errand amount is the total amount of money the errand will cost excluding the Errander fee.

3.5 Total Amount

Total amount is the sum of the Errand amount and Errander's fee.

3.6 Age Verification

Users must comply with applicable laws, including age verification for specific products. Erranders may refuse delivery of products requiring age verification if the User fails to provide valid identification.

3.7 Verified Partners

Verified partners are vendors we have verified and are available on the Mcket platform. Their products, location and existence have been verified.

3.8 Custom Vendor

The custom feature exists for users whose choice vendors are not verified. Any errand to such a vendor is at the User's own risk. SomaMe would not be liable for any incident, whatsoever, regarding a custom vendor. Users are advised to use this option with discretion.

CUSTOM VENDORS ARE NOT VERIFIED BY SOMAME. WE ASSUME NO LIABILITY FOR:
  • Product quality or authenticity
  • Pricing discrepancies
  • Transaction disputes
  • Delivery failures

Customers use this option at their own risk.

4. DELIVERY OF ERRANDS

4.1 Errand Delivery

Users must arrange the delivery service through the Mcket platform. Erranders deliver the Errands to the specified Drop-Off Location.

4.2 Delivery Time

Delivery times are estimated and may be affected by factors such as traffic, weather, and other conditions. SomaMe does not guarantee exact delivery times.

4.3 User's Availability

Users must be present at the Drop-Off Location at the estimated time of delivery. Failure to be available may result in Errand cancellation and associated charges which may be added to the Total Amount.

4.4 Cancellation by SomaMe

SomaMe may cancel Errand delivery and charge the User in cases such as unavailability, inability to contact the User, or failure to agree on a new Drop-Off Location.

4.5 Self Pick-Up

Users opting for self pick-up must adhere to the indicative Order collection time provided on the Mcket platform.

4.6 Erranders' Ratings

Erranders' ratings are based on User reviews. Users can rate Erranders on a scale from 1 to 5 based on their satisfaction with the Errand.

5. COMPLAINTS

5.1 Reporting Complaints

Users with complaints about Errands are encouraged to inform SomaMe through the Mcket platform within one month of the Errand delivery.

5.2 Resolution

While SomaMe is not liable for Erranders' services, it will attempt to facilitate a solution. Refunds or adjustments may be provided if justified.

6. PAYMENTS AND INVOICING

6.1 Errand Fee Payment

Users must pay Total amounts as indicated on the Mcket platform. Prices may differ from those at Erranders' establishments (errand fees).

6.2 Payment Processing

Payments are processed through third-party payment processors. Users authorize payment upon confirming an Errand, and the amount is instantly deducted from the provided account.

6.3 Invoicing

SomaMe issues informational receipts for Errand Fees and accepts payments on behalf of Erranders.

6.4 Cash Payments

Users may have the option to pay Total amounts in cash to Erranders. Cash payments are collected by Erranders. Under the Errander's discretion or by their choice on whether to come for the money before or after the errand.

6.5 Promotional Offers

SomaMe may offer promotional discounts, as per its discretion, on Errand Fees or related services.

6.6 Electronic Invoices

Users consent to receiving electronic invoices as outlined in the Mcket platform's policies.

6.7 Settlement Amount

In the event that the user cuts off all contact with an Errander during an errand abruptly, especially after a purchase has been made by an Errander, the user would have to settle the Total Amount to be eligible to place any other errand.

7. CANCELLATION AND SUSPENSION OF USE

7.1 Order Cancellation

Users may not withdraw from or cancel Errands once confirmed.

7.2 SomaMe's Discretion

SomaMe may remove Users from the Mcket platform or refuse/cancel Errands if Users violate terms, engage in fraudulent acts, or fail to comply with obligations.

7.3 Prohibited Activities

Users shall not use the Mcket platform for illegal activities. Violations may result in permanent suspension and notification to law enforcement.

8. LIABILITY

8.1 Partner Liability

Erranders are solely liable for defects in services provided. SomaMe does not assume liability for any shortcomings in Errand performance except for technical failures and payment processing failures.

8.2 Fraudulent Use

Clients must report suspected fraudulent use of their payment methods. SomaMe is not liable for fraudulent use 48 hours before reporting.

9. MISCELLANEOUS

9.1 Right to Withdraw

Clients have a statutory right to withdraw from Errand Agreements within 7 days of the order date.

9.2 Changes to Terms

SomaMe reserves the right to make changes to the General Terms without notice.

9.3 Governing Law

The use of the Mcket platform is governed by Ghanaian law. Disputes shall be resolved in Ghana.

These General Terms constitute the agreement between SomaMe and Users, effective as of June 12, 2025.
